2. Our products
Better-Told Visual Publishing creates downloadable visual tools, frameworks, guides, templates and decision-support materials for professional and organisational use.
The product description on the relevant sales page explains what is included, the file format and any specific system or software requirements.
Unless expressly stated otherwise, products are supplied digitally. No physical product will be shipped.
3. Ordering and payment
An order is completed when:
1. You submit the required order information;
2. Your payment is successfully processed; and
3. We issue an order confirmation or provide access to the digital product.
Prices are displayed in [euros] and will indicate whether VAT is included or added during checkout. The applicable tax may depend on your location, customer status and VAT information.
Payments are processed securely by Stripe or another payment provider identified during checkout. Better-Told Visual Publishing does not directly store complete payment-card details.
You are responsible for providing accurate billing, tax and contact information.
4. Digital delivery
After successful payment, the digital product will be made available through a download page, email link or other electronic delivery method.
Please download and securely save your purchase. Download links may be subject to reasonable access, time or download limits for security purposes.
If you do not receive or cannot access your purchase, contact [support email address] and include the email address used for the order and your order number.
5. Right of withdrawal for digital content
Consumers purchasing online generally have a statutory 14-day right of withdrawal. Different rules apply when digital content is supplied immediately and is not provided on a physical medium.
Where you request immediate access to a digital product, you will be asked to expressly consent to delivery beginning before the end of the 14-day withdrawal period and to acknowledge that you lose your right of withdrawal once the download or supply of the digital content begins.
If the required consent and acknowledgement have not been obtained, your statutory consumer rights remain unaffected.
The statutory right of withdrawal does not generally apply to purchases made entirely for business purposes. Nothing in these Terms limits any mandatory consumer right that applies to you.
6. Refunds and product problems
Due to the nature of downloadable digital products, purchases are normally non-refundable after delivery has begun and the buyer has validly consented to losing the right of withdrawal.
This does not affect your statutory rights if:
* The product is defective or materially different from its description;
* The file cannot be accessed because of a problem for which we are responsible;
* You were charged more than once for the same purchase; or
* A refund is otherwise required by applicable law.
If you experience a problem, contact [support email address] within a reasonable period and provide your order information and a description of the issue. We will first attempt to provide a working replacement, corrected file or other appropriate solution. Where the law requires it, an appropriate price reduction or refund will be offered.
Refunds are not normally provided because a buyer changes their mind after accessing the product, lacks the required software despite the requirements being stated, or decides that the product is not suitable for an undisclosed purpose.
7. Licence and permitted use
Unless a product page specifies a different licence, purchasing a Better-Told Visual Publishing product grants you a limited, non-exclusive, non-transferable licence to use it:
* In your own professional work;
* Within your own organisation;
* For internal meetings, workshops, planning and decision-making; and
* In accordance with any product-specific licence included with the download.
Consultants and facilitators may use the product as part of delivering their own professional services, provided that the original files, templates or substantial reproductions are not transferred to the client or other third parties unless an appropriate licence permits this.
Purchasing a product does not transfer ownership of its intellectual property.
8. Prohibited use
Unless we have provided prior written permission, you may not:
* Resell, redistribute, sublicense, share or give away the product;
* Upload it to a shared template library, membership platform or public website;
* Repackage it as your own product or include it in another product for sale;
* Remove copyright, branding, licence or attribution notices;
* Make the source or downloadable files available to clients, colleagues outside the licensed organisation or other third parties;
* Use the product to train an artificial-intelligence system or create a substantially similar product for resale; or
* Claim authorship or ownership of the underlying framework, design or content.
Reasonable adaptations made solely for permitted internal use do not transfer intellectual-property rights to the buyer.
9. Intellectual property
All intellectual-property rights in Better-Told Visual Publishing products, including their original text, structure, visual presentation, branding and supporting materials, remain with [legal business name] or the relevant identified rights holder.
Product names, third-party concepts or other materials remain the property of their respective owners where applicable.
Suspected unauthorised use may result in termination of the licence and further action where appropriate.
10. Professional disclaimer
Better-Told Visual Publishing products are facilitation, communication and decision-support tools. They provide structures for discussion and professional judgement but do not guarantee a particular business outcome.
They do not constitute legal, regulatory, financial, tax, compliance, cybersecurity or AI-risk advice. Buyers remain responsible for:
* Assessing whether a product is suitable for their circumstances;
* Verifying important information;
* Obtaining specialist advice where necessary; and
* Making and implementing their own organisational decisions.
Worked examples are fictional unless expressly stated otherwise. Any resemblance to an actual organisation, project or person is coincidental.
11. Availability and changes
We take reasonable steps to describe products accurately and keep files accessible. Minor differences in colours, fonts, formatting or display may occur between devices, printers and software.
We may update, correct or discontinue products at any time. A purchase does not automatically include future editions, additional products or ongoing support unless the sales page expressly states otherwise.
We may provide a corrected replacement where an error materially affects the purchased product.
12. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any mandatory consumer rights.
To the extent permitted by law, Better-Told Visual Publishing is not liable for indirect or consequential losses resulting from the use of, inability to use or reliance on a product, including loss of profit, revenue, opportunity, data or anticipated savings.
For business customers, our total liability relating to a purchase is limited to the amount paid for the product giving rise to the claim, except where a greater liability is required by law.
Buyers are responsible for maintaining appropriate backups and for reviewing products before using them in significant organisational decisions.
13. Personal information
We process personal information in accordance with our Privacy Policy, available at [privacy-policy link].
Our payment, website, email and delivery providers may process information as necessary to complete the transaction and provide the purchased product.
14. Complaints
If you have a complaint, contact:
Email: [email protected]
Subject line: Customer complaint: [order number]
Please explain the issue and the outcome you are requesting. We aim to acknowledge complaints within [five] business days and provide a substantive response within [14] days.
15. Changes to these Terms
We may amend these Terms to reflect changes in our products, business practices or legal obligations. The version applying to a purchase is the version made available when the order was placed.
16. Governing law and disputes
These Terms are governed by Dutch law.
Any dispute will be submitted to the competent court in the Netherlands, unless mandatory consumer law gives the customer the right to bring proceedings in another competent jurisdiction.
Before beginning formal proceedings, both parties agree to make a reasonable effort to resolve the matter directly.
17. Severability
If any part of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be interpreted or replaced as closely as legally permitted to reflect its original purpose.
